NO charges, from anywhere) are**,
 - during continuous, consensual sex,"holding down" a woman during sex (or was 
he just on top?hm..)
 - during continuous, consensual sex, pressing his penis against her back (of 
all theplaces....)
 - during continuous, consensual sex, his not stopping fast enough (to her 
liking) once it was noticed 

                                                                                                            
 said condom had broke,
 -   after continuous, consensual sex, not calling the girl back the next day.

No, really, those are it.
