That Wiki article Pat linked to has a footnote to a Joe Rogan blog where he
calls out Leary as a joke thief, and reckons the local comedy pros he asked
about it at the time all said Leary's a thief:

He is a thief. If you reckon there's not enough similarity, you obviously
never plagiarised your homework and just put it into your own words. Same
topic, same angle, different words. How clever.

It's the principle of the matter. Yes, it is difficult to conceive of
morals, values...right...wrong... in our most enlightened, post modern media
saturated times.
Bottom line: A hack who appropriates the talents of a gifted dying
performer, takes his routine after his death (as well as taking copious
notes and making NCFC before the body was interred) and subsequently profits
off it is morally and emotionally bankrupt. This is not an intellectual
exercise. He needs a right good kick in the arse, and I am being kind.

He hit the nail on the head by comparing the Leary vs Hicks arguement to the
Nirvana vs Killing Joke thing.
