What would the situation be if someone had access to a copy of Gems and had paid for the official release but never received anything?? 

If these copies were lent to other people, would that be illegal if they were lent and no money changed hands?

I don't know the legal situation. Seriously, if there is someone with the definitive word out there I would be interested in hearing about it/

Say this scenario were to potentially happen, do you think that this might galvanize those behind the project to actually do what is right and either send people their stuff or refund the money.

God forbid that an angry mob should strip the merch stall next time killing joke played anywhere....
